Do I need a lawyer?
Lawyers can provide you with advice about the law, and can share with you their knowledge and experience about settling divorce/separation cases.
For an agreement that deals with family property you need independent legal advice to ensure that the agreement cannot be overturned and this requires you to have independent lawyers to have a valid agreement on family property. Lawyers must be involved to do things like transfer the house, other real estate or to get a mortgage.
If you do not use a lawyer, a family property agreement is not binding.
How do I choose a lawyer?
Choose a lawyer who has your best interests at heart. Check to see if they have training in mediation or collaborative law. Make sure that the lawyer understands your goals and desire to settle. If they start talking about court early, question them about whether your case will ever go to trial.
Can I talk to my lawyer at any time?
Yes. If you need to discuss anything with your lawyer you should do so whenever the situation arises. They can also communicate with the mediator and review any documents that have been produced.
Your lawyer may attend any mediation meetings.
